Terms of Service

1. Acceptance of Terms

By creating an account, purchasing credits, or connecting to proxy endpoints, you accept these Terms, the Privacy Policy, and any applicable Data Processing Agreement. Signed master agreements take precedence over these standard Terms.

2. Definitions

  • Account: Registered user profile and login credentials
  • Endpoints/IPs: Atheris-managed proxy nodes with 4G/5G device connections
  • API Key: Programmatic access credential
  • Abuse: Any prohibited use or activity violating law or sanctions

3. Eligibility & Compliance

Users must have legal capacity, act for business purposes, comply with applicable law, and not be subject to EU/UN/US/UK sanctions. Estonia's information-society regulations apply.

4. Registration, Security & API Keys

Users must provide accurate information and maintain confidentiality of credentials. You are responsible for all use under your Account and API keys. Identity or sanctions screening may be required.

5. Service Description

Atheris provides enterprise-grade mobile proxy infrastructure using real device connections and carrier IPs. We do not guarantee access to any specific third-party website or particular IP trust scores.

6. Ordering, Term & Renewal

Plans may be credit-based or subscription-based with automatic renewal unless cancelled. Service modifications require notice via dashboard or email.

7. Fees, Taxes & Invoicing

Fees are due upfront unless stated otherwise. Estonia's VAT rate is 24% as of July 1, 2025. Invoices are issued electronically.

8. Refunds & Chargebacks

All purchases are non-refundable unless mandated by law or stated in specific agreements. Chargebacks result in immediate account suspension.

9. Data & Privacy

Users act as data controllers; Atheris acts as processor. We process only what's needed to provide the Service under GDPR requirements. Minimal metadata is retained for billing and security purposes.

10. Network Fair Use

Rate limits, session caps, rotation rules, and automated blocks protect network quality. Bypassing these controls is prohibited.

11. Prohibited Use

Users cannot use the service for:

  • Violating law or circumventing platform terms
  • Distributing malware or executing DDoS attacks
  • Trafficking illegal content or exploitative material
  • Committing fraud or payment fraud
  • Scraping personal data without lawful basis

We may suspend without notice for suspected abuse.

12. Sanctions & Export Controls

Atheris screens for sanctions exposure and may request verification documents. Users warrant non-residence in comprehensively sanctioned jurisdictions.

13. Safe-Harbour & Takedown

As an information-society provider, Atheris acts as a mere conduit with no general monitoring obligation. Abuse reports: [email protected]

14. Security & Support

We maintain reasonable safeguards and notify users of significant security incidents. Support is provided on a commercially reasonable basis.

15. Suspension & Termination

Suspension or termination occurs for material breach, non-payment, sanctions failure, or abuse. Users may terminate anytime via dashboard with non-refundable prepaid amounts.

16. Intellectual Property

All service materials remain exclusive property of Atheris or licensors. Users receive a non-exclusive, non-transferable, revocable right for internal business use.

17. Warranties & Disclaimers

The Service is provided "as is" and "as available." All warranties are disclaimed. Third-party site blocking is outside provider control.

18. Limitation of Liability

Liability will not exceed the fees you paid during any 12-month period. Indirect or consequential damages are excluded.

19. Indemnity

Users defend and indemnify Atheris against claims arising from service misuse or breaches.

20. Governing Law & Disputes

Estonian law governs. Business disputes resolve through arbitration at the Estonian Chamber of Commerce Court of Arbitration. Consumers may use their habitual residence courts.

21. General Provisions

  • Force Majeure: Neither party liable for uncontrollable events
  • Notices: Communication via registered email
  • Assignment: User assignment prohibited without consent
  • Entire Agreement: These Terms plus any DPA/SLA constitute the complete agreement
