1. Introduction
These Terms and Conditions ("Terms") form a legally binding agreement between you ("User", "you") and Atheris.ee ("Atheris", "we", "us", or "our"). By accessing or using our website and services (the "Service"), you agree to comply with and be bound by these Terms. If you do not agree with any part of the Terms, you must not use the Service.
Atheris connects proxy providers ("Vendors") with individuals or businesses ("Customers") seeking proxy services for lawful online activities. Vendors are operators of 4G mobile devices or networks that allow Customers to route internet traffic through their infrastructure.
You confirm that you are of legal age in your jurisdiction and have the authority to enter into these Terms.
2. Account Registration
To access the Service, you must register for an account ("Account") and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your Account. We may require identity verification ("KYC") at our discretion and reserve the right to suspend accounts that fail verification or provide false information.
3. Acceptable Use
By using the Service, you agree not to:
- Violate any applicable laws, regulations, or third-party rights;
- Use the Service for unauthorized governmental or surveillance activities;
- Distribute or promote malware, spyware, or other harmful software;
- Engage in Denial-of-Service (DoS) or Distributed Denial-of-Service (DDoS) attacks;
- Share or access unlawful, offensive, or abusive content;
- Compromise network security or gain unauthorized access to devices or data;
- Use stolen payment instruments or impersonate others;
- Send spam or other unsolicited content;
- Attempt to reverse engineer, disrupt, or exploit our platform;
- Use the Service in a way deemed abusive or fraudulent by Atheris.
Violations may result in account suspension, loss of funds, and reporting to law enforcement. We reserve the right to determine what constitutes a breach or misuse of the Service.
4. Rights and Suspension
We may monitor usage to enforce our policies and comply with legal obligations. We reserve the right to suspend or terminate your Account without prior notice if:
- Your actions pose a risk to the Service or its users;
- You are blocked by third-party services due to Service usage;
- Your activities expose us to legal or reputational risk;
- You violate any part of these Terms;
- You fail to complete verification or provide truthful information.
Suspended accounts are not eligible for refunds unless required by applicable law. Digital service purchases are final once delivered unless otherwise stated.
5. Intellectual Property
All intellectual property related to the Service, including content, interface, design, and software, is owned by Atheris or its licensors. You may not copy, modify, distribute, or create derivative works from the Service without express written permission.
6. Modifications
We may update or modify the Service or these Terms at any time. If changes materially affect your rights, we will notify you via email or through the Service. Continued use of the Service after such changes constitutes acceptance of the updated Terms.
7. Disclaimer and Limitation of Liability
The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Atheris is not liable for indirect, incidental, or consequential damages, including loss of profit, data, or business interruption. Nothing in these Terms excludes liability where it would be unlawful to do so, such as for death or personal injury caused by negligence.
8. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Republic of Lithuania. In case of a dispute, parties agree to attempt resolution amicably. If unresolved, disputes will be submitted to individual arbitration, unless restricted by applicable consumer protection laws.
9. Miscellaneous
These Terms constitute the entire agreement between you and Atheris regarding your use of the Service. If any provision is found unenforceable, the remaining provisions remain in full effect. You may not assign your rights under these Terms without our prior consent.
We may deliver legal notices via email or platform messages. Notices are considered delivered 24 hours after posting or 48 hours after sending by email unless a delivery failure is received.
By using the Service, you acknowledge that you have read, understood, and agreed to these Terms.
